I. Terms and Conditions

 

§ 1 Basic Provisions

 

(1) The following Terms and Conditions apply to all contracts concluded with us, the provider DreamyTales GmbH, via the website www.dreamytales.com. Unless otherwise agreed, we do not accept any of your own terms and conditions that may conflict with or differ from these.


(2) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are not primarily related to their trade, business, or profession. A business customer is any natural or legal person or partnership acting in the course of a trade or business when entering into a legal transaction.

 

 

 

§ 2 Formation of Contract

 

(1) The subject of the contract is the sale of personalized goods.


(2) By listing our products on our website, we make a binding offer to conclude a purchase agreement under the terms described in the respective product description.


(3) The contract is concluded through our online shopping cart system as follows:

 

  • The goods you wish to purchase are placed in the shopping cart.

  • You can view and modify the cart at any time before completing your purchase.

  • After entering your personal details and choosing your payment and shipping options, you’ll see an order summary for review.

  • Before submitting your order, you can check and edit all details or cancel the order.

  • By clicking the purchase button (“Buy now” or a similar label), you accept our offer, and the contract becomes legally binding.

 


(4) Order processing and communication related to your purchase are handled automatically by email. Please ensure that your email address is correct and that our messages can be received (e.g., not blocked by spam filters).

 

 

 

§ 3 Payment Methods

 

We currently accept the following payment options, depending on availability in your region:

 

  • Credit and debit cards (Visa, MasterCard, American Express, Discover)

  • PayPal

  • Apple Pay and Google Pay

  • Shop Pay

 


Payment is due at the time of purchase. Your order will be processed once payment is successfully completed.

 

 

 

§ 4 Retention of Title

 

The goods remain our property until full payment has been received.

 

 

 

§ 5 Warranty

 

(1) Our products are subject to the statutory warranty rights applicable under U.S. consumer protection law.


(2) Upon delivery, we kindly ask you to inspect the product for completeness, visible defects, or shipping damage and to notify us promptly of any issues. Failure to do so does not affect your statutory rights.

 

 

 

§ 6 No Right of Withdrawal for Personalized Products

 

Because all our products are personalized and made to your individual specifications, there is no right to cancel or return once production has started or the product has been delivered.


This applies to all products that include custom text, names, photos, illustrations, or other elements based on your input. Personalized items are therefore non-refundable under U.S. consumer law exceptions for custom goods.

 

 

 

§ 6a Voluntary Courtesy Cancellation Policy (Before Production)

 

(1) Although there is no legal right of withdrawal for personalized products, we offer a voluntary courtesy refund if you cancel before your personalized product has been completed.


(2) Cancellation is only possible until we notify you that your product has been finalized. Completion is confirmed by:

 

  • Shipping confirmation email (for physical products), or

  • Delivery confirmation email (for digital products).

 


(3) If you cancel before completion, we will refund 50% of the purchase price as a goodwill gesture. The retained 50% covers design, editing, file preparation, and administrative costs already incurred.


(4) Shipping costs (if any) are non-refundable. Refunds are issued via the original payment method within 14 days after receiving your written cancellation.


(5) To cancel, please email us at service@dreamytales.com and include your order number. Cancellations after completion are not possible.


(6) This goodwill policy is offered voluntarily and does not establish a legal right. It applies in addition to your statutory warranty rights.


(7) We reserve the right to modify or discontinue this courtesy policy at any time. Changes apply only to future orders.

 

 

 

§ 7 Governing Law and Jurisdiction

 

(1) These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles.


(2) The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms shall be the competent courts of Delaware, unless otherwise required by mandatory consumer protection law.


(3) The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

2. How the Contract Is Formed

 

The technical steps for entering into the contract, the conclusion itself, and correction options are described in Section § 2 of our Terms and Conditions.

 

 

 

3. Contract Language and Storage

 

(1) The contract language is English.

(2) The complete contract text is not stored by us. Before submitting your order, you can print or save the order summary using your browser’s print function. After placing your order, we will email you a confirmation containing all relevant details and these Terms.

 

 

 

4. Cancellation Policy

 

Because our products are made specifically for you and clearly personalized, there is no statutory right to cancel or return.

However, you may be eligible for a 50% courtesy refund if you cancel before your personalized product has been finalized (see § 6a above).

 

 

 

5. Key Product Features

 

The essential characteristics of each product are described in the respective product listing on our website.

 

 

 

6. Prices and Payment Terms

 

(1) All prices shown on our website include all applicable taxes and fees unless otherwise stated.

(2) Shipping costs (if any) are displayed separately during checkout.

(3) All payments must be made in U.S. dollars.

(4) Orders will not be processed until payment has cleared.

(5) Any transaction or currency conversion fees from your bank or card provider are your responsibility.

 

 

 

7. Shipping and Delivery

 

(1) Delivery times and shipping options are displayed on our website or during checkout.

(2) We ship from our production and fulfillment partners located in the United States or Europe, depending on the product and destination.

(3) The risk of accidental loss or damage passes to you upon delivery.


If you select your own courier or freight service, risk passes when the product is handed to that carrier.

 

 

 

8. Warranty and Defects

 

Our warranty obligations are governed by Section § 5 of these Terms.

If you receive a defective or damaged product, please contact us immediately at service@dreamytales.com. We will assess the issue and, if applicable, provide a replacement or refund in accordance with applicable law.
